My ex has custody of our daughter, we were never married. Is there anyway that I can modify visitations without having to go to court?

    Yes, you can.

    Broach the subject to him in person, over the phone, or in writing. If you are able to reach an amicable arrangement by yourselves, document the new agreement and/or list of amendments to the old agreement in triplicate, sign and date them yourself and mail them to him to sign and date. These signatures should be witnessed by a thrid party, but not by your spouses or partners. He can retain one copy and return the other two to you. This gives each of you one copy, with a third available for the use of the court, if it is needed.

    If you are unable to reach an amicable agreement and have it documented, you will need to pursue this matter in court.

    Red John's response presents a great way to address this isue without going to court, as long as you keep in mind that the agreement cannot be enforced unless you go to court. In other words, if your ex breaks the terms of the agreement, you can't do anything about it unless you file a complaint, and that will result in a court proceeding.
