That actually depends on how the application for the new marriage license is worded. In Michigan says Last marriage ended by _____________ & the options are divorce, annulment, or death. In that case you would have to say annulment. In Texas it asks if you are presently married, if you are divorced it asks whether or not the divorce occured within the past 30 days. It does make any mention of annulments. So there's really no way to give you a definite unless we know where you plan on getting married next. Although if you've found someone you want to marry it's probably not a good idea to keep your prior marriage a secret because now they'll have grounds for an annulment from you.

Provided your marriage is legally ended there is no reason you would be prevented from getting a license.

Why would you want to not say that you had been previously married? It is better to be honest, surely.
