Can a pre-paid cell phone be tapped. if so will it hold up in court

    Yes they can, but in order for it to be tapped you need a warrant from a judge and they will need to go to your service provider. Its not like the movies.

    Not that easy either. It has to be a Federal Judge, because of the FCC. Even the FBI has a certain limit of "taps" that they can use LEGALLY. The exception is monitoring terrorism, which has different judicial boundaries. It is possible for anyone to listen in at any time if they know how. As long as you have an attorney with a third of a brain, that info will never hit the judges ears since it was obtained illegelly most likely.
