  • yes, it has happened 3 years in a row to a coworker I know. Why would you want to marry a guy who owes child support anyway? It clearly shows he does not take responsibility and is selfish. Sorry I guess I am bitter about the subject, dont mean to sound harsh. EDIT: let me add also, I'm not saying this IS the case, but you may want to be weary. If he owes a lot of money he may me trying to marry you to settle his debts. Chances are he doesn't have a license right now, so he may want to get that back without having to fork over any money.

  • He owes back child support? If so, then when you marry him, his debts are your debts. Just a bit of advice; wait until he is all caught up before making your wedding plans. It's really irresponsible for a man to spend money on anything else when he is not supporting his own children. I don't know all the details but a man that doesn't support his own children is not the best choice. IMO
  • I have to agree with what a couple other posters said: Why would you marry a man that owes back child support? It shows he is irresponsible. I would seriously check on his finances before you consider marriage to him. Do you really want to have your name attached (financially speaking) to a man who is financially irresponsible?
  • As far as taxes go...yes but i believe that is only if you file jointly. However, once the two of you are married, your income is counted as one, and if he owes enough money and still isn't paying it, the government can take it from you if they see that he is able to pay it with your income.
  • I would agree with the other answers posted. Dont be surprised if in 5 years we see this question from you, "My ex owes back child support and I dont know what to do", pay attention to this, he is showing you what he is.

  • I'm going to guess the other 9 responses are women that have been screwed over by a man. So because a man has child support he is irresponsible? Wow no wonder you ladies are single. I am married to a man that pays current and back child support. I love him and support him. He's taking responsibility and has been but don't ever give a woman cash as child support because she's surely to screw you when the courts get involved. For the men that read this always have record of any money you give to your ex for child support.
  • Here in Michigan they have a paper you fill out and file BEFORE you marry with the courts so that you do NOT have to pay you new spouses past debts. I can not think of the name of it exactly but I know that we have it here. On a side note - I would really think about marriage with a man who doesn't pay child support. You might be getting yourself in hole that you won't be able to dig yourself out of - and it doesn't sound like he will make it any better for ya. If anyone can put their own flesh and blood off to the side they can and will put ANYONE off to the side.
  • I don't personally know the guy BUT I met my husband when he was 23. He owed support and didn't see his kid due to the ex being a witch. I ended up paying on his support then at income tax return time they took the rest out of our taxes. He is a great husband and father to our 4yr old boy and my 3 kids!! So the point here is maybe he is a loser OR maybe he was just in a difficult position and his ex really stuck it to him w/support! I say quit ragging on him and the OP. Only she knows what kind of guy he really is!

  • If you file jointly they will take the entire combined return and apply to what he owes. You can file separately (which will allow you to receive your return but will cause certain deductions to be reduced or disallowed) or you can file what is called an Injured Spouse form which can be attached to the joint return.
  • Good grief, why, oh why would you marry this guy?? My ex's father stiffed his mother with the cost of raising their three children. My ex hated his dad for this. Well, guess what...the son turned out to follow in dad's footsteps--we divorced 9 years into the marriage and I've never seen a dime of child support. Our child is now grown, and he owes me somewhere in the neighborhood of 30,000 US dollars. History does repeat itself, so tread lightly. As far S if they can garnish your wages, I would think that would differ from state to state, country to country. This is probably a question that could easily be answered by your local child support recovery unit.

If you marry, unless you place an order of financial injury - then yes all of the refund will be intercepted to pay the past State Bill. However, the IRS has a for call the Injured Spouse Allocation Statement, www.irs.gov/pub/irs-pdf/f8379.pdf. This form is sent in with ther return, best scenario. This will allow the IRS to review your return manualy. The IRS will then apply your state law and split the refund accordingly to the income reported. You as the injured spouse will recieve your fair share. For additional questions, please call 800-829-1040 and request assistance with Form 8379.

  • These comments are funny lol. Why would you assume that the man is a deadbeat right off the bat. Child support systems in this country are broken to such an extent that they can be called criminal extortion. Im in no way saying that not paying child support is ok, Its not. What people fail to realize though is that its very easy to lose a job and become behind on child support payments. The OP never stated how much he owed and the minimum for them to take your taxes would be 2500 dollars. That in some cases can be two or three months of missed payments. To say someone is a deadbeat parent for missing two or three months due to unemployment is rediculous and only shows how cold your heart is.

  • Yes you may if do not file a injured spouse form. As for all the comments about your man, there are several legitimate reasons and man could fall behind in child support. For example...the state takes a pay stub and multiplies it x 52 weeks for the gross income. Well if that man works construction and is in an apprentiship.. odds are he won't work 52 wks a year. $639 a month for 1 child when he only qualifies for $824 in unemployment a month. $360 of it is for day care, the mother quits her job and gets married to b a stay at home mom. Nine months of $360 adds up when you finally get to court and they won't back date the change to the last day care date. I know that not all men that are behind in child support are dead beats and not many get their child every weekend either.
