  • Wouldn't it be more to the point if she sued her husband? After all, it takes two people to make a mistress. Perhaps the best thing the wife can sue for is divorce.

  • There is some fairly recent case law where wives have done just this and won. However, it is extremely difficult and will only fly if you are in the right state and jurisdiction. I think that there are very rare cases where this is justified. In most cases, it's a wife trying to blame the mistress for what her husband is responsible for. The mistress is not responsible for the wife's relationship with her husband.
  • I think a wife should be able to sue the mistress for emotional distress because eventhough it does take two for an affair to fly, the mistress knowingly goes into a relationship intending to break that bond between a couple. Now, if she does not know that the man she is having an affair is married, that's another matter. Once she does discover he is married, the question is, is it moral for her to continue a relationship knowing that if she does, she may cause the death of a marriage. There is a case where a wife did sue the husband's mistress and won.
