  • To avoid unnecessary arguments between the kids in later years I woul go with trust.
  • They have different functions and it depends on each individual's situation. It generally isn't that one is better than the other and you may need both.
  • Ok as far as them having to pay less tax or probate costs which would be better? Trying to save them any headaches associated with the government.
  • The will is mostly for how things like money and houses are divided between the kids. A trust is more like how much, how often, and when they get it. You'll probably need both unless your kids are older and able to make financial choices for themselves.
  • A trust is better. Especially if it is set up as a partnership where each child will get a vote on how the others spend it.Sort of protection against crazy spending. It is what I was given with my siblings and it has worked out great. Lower taxes... no spousal rights to the $ and if something happens to me, my chihldren will have a shared seat on the trust.

  • I think a trust would be alot better.....It's not read infront of every one....It's more personal so there shouldnt be any hard feelings.......And would probably cause less emotional distress
  • Everyone should have a will, even the children. You can also have a trust set up if you desire.
  • both..! my mom put her house in a trust for her kids. Also my b/f's parents put their homes in a trust so no one can touch it when they die. But you need to have a will too.
