  • State sales tax is only charged if the company has a store of outlet in the state from which the item is ordered. The company may be located in another state, but if the company has a store in your state, i.e. Sharper Image, then state sales tax is charged at that states rate. This is also true of Ebay.
  • Just to add to PhilDoc's answer, I know of one state where it does not matter if the person/company does not have a presence in the state. That state is Utah. If you order something from a business that is in Utah then it is the business' responsibility to collect the sales tax. However, if you order something from a business outside of Utah for use in Utah, then it is your responsibility to pay the sales tax. The actually have a place on the Utah tax return form where you are supposed to declare the value of such purchases and then calculate and enter the amount of sales taxes you owe on them. I don't know how many Utahans actually declare such purchases, but if the state finds out that you don't, then you can become subject to legal action to get the money from you.
