  • A citation is almost never invalid because of errors on the citation. The only time errors really help you is when they are material, and you use them as leverage to get the court to dismiss the case on efficiency grounds. For example, lets assume that instead of citing you for MIP, the officer wrote the vehicle code for DUI. Does this invalidate the citation? No. However, due process requires that you have advanced notice of the charges against you. If you go to court, plead not guilty, and at trial the officer begins making the case for MIP, your defense is simply to tell the judge that you are not prepared to defend a MIP charge because you were cited for DUI. Does this mean the case is dismissed? Not necessarily. The prosecutor can always modify the charges and the judge can reschedule you for trial on another day. If you are accused of a traffic violation, the court will usually just dismiss the case due to efficiency. If the charge is more serious, the charges may be amended.
