It depends on a few things: the type of ownership, exactly how ownership is divided and what the equitable contribution was to the business by both owners. If you sat at home and ate bon bons while your husband worked 80 hours a week at the business then it is possible that a court may give your husband a larger share of the business. Often, one of the spouses will often buy the other spouse out of the business. If the couple can't amicably decide how the business should be handled then a judge will - and neither of you may be happy with his decision. Try to handle it yourselves as best you can.
