A verbal will is a touchy issue. For the verbal will to be upheld, it should be heard by more than one person and should be heard by people who are disinterested persons. Persons who have no interest in the estate, as in they will not inherit. However, there are many reasons why a verbal will is not always upheld. For instance, people's memories are faulty; the person giving the verbal testimony may not be specific enough as to what their wishes are; and a written will may have been done at some previous time. Even a handwritten will with no signature (written entirely in the testator's own handwriting) that is unsigned will have more weight than a verbal will and is more compelling. It is always best to have a written will and to give a copy of it to a trusted friend, family member or attorney.
