Can your employer ask for money back if you have been overpaid substansially but you no longer work for that company, signed all necessary papers on leaving, but still continued to get paid..?

    Absolutely as that is legally considered theft if you knew that it was being paid in error. They can take you to court to get the money and they will win.

    Yes. In fact, it is a crime to cash a check if you know that it was paid to you in error.
