I got a ticket for making a right turn on a red light at a "no turn on red" corner. The sign is hard to see, and it was nighttime. Can I fight the ticket on those grounds?

    personally, I'd just pay it being grateful no one was hurt....but I would bring it to the attention of those concerned the 'hard to see at night' sign.....

    All traffic signs are designed and located to give the motorists the optimal vision in day time and at night. i was not there, but i find it hard to believe, that of all the other people that obeyed this sign, you are the only one the officer cited, for not obeying.

    Nighttime is not an excuse. If "hard to see" means it was blocked by a low-hanging tree, had been turned so as to not be visible from your lane or was otherwise not in working order or visible, you could take a pitcure and probably have th eticket dismissed and the problem with the sign corrected.

    If it was just hard to see because it was night and you were looking the other way, be glad it was a sign and not a pedestrian and pay the fine.

    Of COURSE, fight it. Acquire all the documentation you can of the situation, and go for it. I suggest you demand a real judge, not a commisioner or judge pro tem, though. No guarantees, though, as our local courts, in my experience are very corrupt. My guess is that you will--at least---get a significant reduction of the fine/bail amount. FIGHT, FIGHT, FIGHT!!

    If you think you can prove to the judge that the sign is hard to see in the night... then go for it... you'd have to present a chart of the intersection to demonstrate what you saw, and take photographs in day time and night time so the judge can see how hard the sign is to see at night.
