    You both own it? No she can't do it. However she could make up some bogus domestic violence charges and get a restraining order taken out on you, basically kicking you out of the house.

    If one spouse breaks the law (such as spousal abuse)and the police and courts get involved, then the courts can decide.

    If it is just an argument between two people and no laws are broken, then I don't think so. If the situation has gotten that bad, then you need to get a lawyer or counselor.

    Can a wife just throw out her husband even though he is not on the deed,and they have been married for just over a year but have been living in the same house over 10 years in which time the husband rescued the house from foreclosure?

    Are you divorced? Is there a divorce agreement that you are legally bound on the mortgage and have right to possess the premises for your residence? With a divorce decree stating that you retain possession of the home with right of residence, you will have to legally evict your husband. It can be done but must be done according to the rules of your state and the statutes regarding eviction.
    If there is no divorce or legal binding agreement that gives you exclusive use and possession of the home, then no you cant evict your husband.
