Is it legal to purchase absinthe from another country if you live in the United States?

    Short answer: YES (unfortunately)

    Long answer: the law is very wishy washy in this area. In the US, thujone (an unfortunate component in Artemesia Absinthium, or Wormwood which is used to flavor absinthe)is banned by the FDA for human consumption. It is not a controlled substance and as far as I know it is not on the books in any state as being illegal.

    The problem comes in TWO PLACES...with the importation of the alcohol which one is supposed to pay duties (taxes) on if they want to import it into the US and the fact that the CBP (Customs and Border Patrol) lists "absinthe" as a prohibited item for importation into the US. The funny thing is that the CBP don't cite a specific federal law...

    Even though absinthe is not a controlled substance, it cannot be imported via the CBP.
    So, if you get a bottle of absinthe shipped to you, you may not technically be breaking any laws *per se* but you more than likely are not paying your duties on it, making it illegal.
