Help answer this question below.

I was wondering I just turned 19 and I wanted to take my father to court for 10 years worth of child support I was wondering my mother doesn't want anything to do with it but I think I am entitled to that money to use for college could I take him to court

    Hey, there....you haven't been back for a long time. Hope nobody turned you off this website. It can be very helpful. There are a handful of idiots on here...but that's OK.

    It may also depend on the state that you are in. Some states consider back-owed support to be owed to the parent (who presumably made up the difference when not receiving the support), and some states consider it an asset of the child. A good family law attorney can determine whether you qualify to pursue this on your own.

    Was the child support previously court ordered, and just never paid? If so, you can. If not, there is a statue of limitation that will limit how far back you can sue for. Furthermore, you will have a hard time proving how much he should have been paying.

    Also, you should consider whether or not you can collect if you win. If your father has no assets, a judgment won't do you much good.

    Good idea...you have a right to that money and your mother may have to be involved as a witness to swear that she never received any child support. You must get a family lawyer to represent you. Go for it....'deadbeat dad' needs to feel some consequence of his decisions.
