  • I'm sure any court would consider that , you would need proof or let the judge talk to your daughter in private
  • At that age a person can usually make the decision of where they want to live. I am sure that the judge will take all things into consideration and speak to your daughter about the situation.
  • when a child is 12 the court nomaly goes with there wishew dont think you will have a problem when they hear all the facts good luck
  • Don't lose sight of the fact that there are two sides to every story, and a story told by a teenaged girl who wants sympathy is a mighty fine tale indeed. In most states, a child of that age is considered to be able to declare which parent they'd prefer to live with. Should she move in with you, may I be so bold as to recommend family counseling to help with the transitions that would arrive with her baggage? I only offer this because I found out the hard way that being a step-parent has to be the most difficult job that I can imagine ever having. I was terrible at it and I regret many of the choices I made.
  • At that age courts will let the child decide where they want to live. As I teach, though, and work with teenagers daily, it is quite possible the picture that is being painted is geared towards getting what the girl wants. Getting yelled at is what most kids would say happened when they are corrected or repremanded. They are unhappy when they can't have their own way or do whatever they want to do. Make sure the daughter is not coming just because she thinks Dad is easier than Mom.
  • yes but she will have to tell the judge who she wants to live with and why.
