You're reading In California, how long after going to court does a divorce become final, and the partners free to remarry?
- which can also be phrased in the following ways:
Comments
NO, NO, NO, NO!
This is ENTIRELY INCORRECT!
From your OWN SOURCE:
"The six-month period begins on the date the respondent was served with the appropriate documents or appeared in court, not from the date of filing."
This is NOT the date of the divorce! This is the date the official documents were served to the respondent OR when they first appeared in court!
THIS IS NOT THE SAME AS THE DATE OF THE DIVORCE!
If the divorce occurs 6 months or more AFTER these events, then the divorced people are free to IMMEDIATELY REMARRY after walking out of the court the day of their divorce.
There are a couple other aspects about this date that apply as well, according to your cited reference.
And another important aspect you DON'T mention is that EVEN IF THIS SIX MONTH PERIOD HASN'T PASSED you can petition the court for a "bifurcation" for the purpose of remarrying during that period of time.
Another source to read about this:
http://www.ocdivorcelaw.com/law.htm
Also, even if a couple DOES marry during this time frame, it DOESN'T MEAN THEIR MARRIAGE IS VOID! Rather, it means the marriage is VOIDABLE. This means that either person can petition to have the marriage declared legally void at a later date due to not meeting the 6 month requirement.
