  • You never have a choice, except when you have a contract that says otherwise.
  • The employer sets the work schedule, and it is probably in your employee handbook, or was explained to your when you were hired. The employer does not want you to work more than 40 hours in any seven day period, because he would have to pay overtime, as required by law. The only exception would be if there was a work agreement for a "flex" (or flexible) work week.
