If you can possible avoid it...never buy in a HOA. They have no governing body and more or less can do whatever they want. I have lived in my townhouse for 4years and have been harrassed the entire time. Now they are telling me to get rid of my dog who has never caused any problem and never been out until recently. They are calling him vicious and dangerous because he went to go see and greet as dogs do a puppy and the owner got scared...seriously rethink purchasing an HOA property.

I would double dog dare an HOA to tell me to get rid of a dog because he got chunky. Seriously, I'd call a lawyer on this one. State law will determine the enforceability of the contract.

I don't know how large your townhome is, but they're usually more like an apartment. I live next door to two large dogs and their barking drives me insane, plus I'd have to disclose the noise when I sell my place. They finally had double paned windows installed and plantation shutters so the dogs can't see outside to bark at passersby (I live at the beach). Now I seldom hear the dogs, but I don't feel a townhome is normally large enough for big dogs. They need a yard to run and romp in. And where no one is within 6" to be disturbed by their barking!

Do the dog thing and hike your leg on them...HOA's are a pain in the ASS.

Please check my comments below. The by-laws are quite clear and legally binding. If the limit is 60#. THAT is the limit. If it is 50#, then you need to be looking for another property, perhaps a single family residence without any associated HOA.
