  • Were you parked on a highway? The General Statute reads: "...no driver may transport, carry, possess or have any alcoholic liquor within the passenger area of any motor vehicle upon a HIGHWAY in this State except in the original container and with the seal unbroken." (625 ILCS 5/11-502a) Not sure about IL, but in NC, there is defined a "Public Vehicular Area," (like parking pots or drive-thrus, etc) where it's treated as a "highway," and the same laws apply as if you were actually on a highway. I'm not sure about the penalties or fines, but if you can disprove ANY part of a General Statute in court, they cannot convict you.
