  • Probably none. any rear end collision is 99.9% of the time, the behind drivers fault. this law is pretty well standard in all the states. you say your brakes failed. was there an actual mechanical failure of your brakes, or did the wet street and folllowing too close, make you at fault? someone is always at fault in an auto crash. the law states that you are to have your vehicle under control at all times. sounds like the officer made the right call.
  • in texas bud you are no way getting out of that one been living there for 18 years now if you rear end someone automatically you are at fault but they do have one of the top accident scene investigating offices for that depends how far you wish to go with this for example someone can back into in texas you are still at fault but with that you can easily fight it and get it thrown out of court any other state i do not know but for sure seen plenty of times in texas automatic citation for that

  • That's a tough one. It may be very difficult indeed as you are required to adjust your speed and following distance based on the weather.
  • Your brakes did not fail due to the rain. you were following too close. You are at-fault. Your insurance will have to pay for the damages. You will be found guilty in court. Might as well pay the fine and go on with your life.

  • Very poor. Anytime you read-end someone, the cops figure you were following too close.
  • You can always sue your car manufacture or for your mechanic for fraud. Since they took money for repair and they never did it correct or in manufactures case because they charged you for a faulty car.
