My ex is living with her boyfriend. Can the boyfriend claim our children on his taxes even though he has no legal connection to them?

    In Canada: no. Only one of the children's parents is allowed to claim the deduction for dependent children. This means that only you or your ex-wife could make this claim.

    If more than one person tries to claim the children, it is likely to be discovered through a routine audit this year or at a later time. The taxpayer is not always contacted when an audit of their return is performed, unless he or she needs to provide additional information. A certain percentage of returns are audited as a matter of course each year and certain patterns of claims are audited more regularly than others. My impression has been that revenue departments keep a close eye on claims by separated and divorced persons to ensure that 'doubling-up' on deductions does not occur.

    No, her boyfriend cannot claim your children. Only you or your ex may claim them. In the past he could have claimed them if he could prove that he provided more than half of their support, but in 2005 this rule changed.
