  • Unless you commited whatever your employer deems "gross misconduct," it's typically illegal to fire someone while they are on a legitimate leave of absence. If your employer has paid maternity leave, it will be a different course of action than if you are using Family Medical Leave (not all employers have to abide by it - such as those with very few employees). My main thought is that either you did something prior to going on leave that they are just now reacting to, or you have employers that believe their employees are idiots (which is usually the case), and will just get fired and not do anything about it. If that's the case, don't let them get away with it. The fact that you were pregnant will keep most employers from terminating during the pregnancy, because that's an easy lawsuit they won't win - hence waiting until you HAVE the baby to do it.   • if you filled out fmla paper work you have 12 weeks of unpaid leave. if your out on disability the fmla runs congruent with this, in other words you can't take 6 mst disa, and then request fmla, you fmla time will have expired. simplified 12 weeks no pay then term is ok
