  • It depends upon the state of residence of the deceased. Generally, if an estate is properly probated, claims of creditors will be barred after a short period of time(usually 6 mos to a year). If the estate is not probated properly, state contract law would apply, which could have a stateut of limitations anywhere from 1 year to 4 years (depending upon the nature of the claim and creditor). It is very state specific. Claims by potential beneficiaries are a completely different issue, but again are very state specific.
