Can a company use a staff service to allow hourly ee's at a supervisory level to work PT to get more hours then 40. OT was eliminated. ee's want more hours. Temp position is a labor position. Is this ok? Or will OT be required 4 hours worked over 40?

    It sounds like you're saying that temps are being hired part time to fill full time supervisor jobs. For example, three people working 50 hours total get paid for 16.67 hours each. This is actually legal. OT is paid only to people who are non-exempt and who work more than 40 hours a week. The three employees in my example are not working 40 hours.

    I am not sure what you are asking, but I will try to answer.

    1) Will OT be required if you work 4 hours over 40 (or 44 hours)? Yes, assuming that you are an hourly or non-exempt salaried employee.

    2) Can a company use a staff service to allow hourly ee's at a supervisory level to work PT to get more hours then 40? I am not sure what you are asking here. If supervisory workers are part time, they would be working under 40 (not over 40). But you have no right to work a set number of hours, except if you have an employment contract guaranteeing a certain number of hours.

    not so fast...batman.. the eeoc has held that companies that try to play games with overtime will be penalized and will have to pay everyone in the pool overtime and penalties...be very careful ...you are on shallow ice
