  • (Aloha, NHBaritone. I'm new to AB and glad to be here.) It seems impossible to predict the outcome of that. On face value, it would appear that clause would require recognition. However, recognition is not the same thing as legalizing gay marriages in all states. A state may be required to recognize a Massachusetts marriage, but it doesn't mean they will have to start marrying gays in their own state.

  • Yes. Plain and simple, yes.
  • I would expect so -- for example, other states recognize a New Hampshire marriage of a 13-year-old with parental consent -- but then again, the USSC might say that the word "marriage" means something different in other states than it does in Mass. It all depends on the USSC members.

  • We are talking about licensed marriages, no? A license is permission from govt to do something that is otherwise illegal. Does that sound like marriage? Marriage licenses began (I don't remember when) as a license to marry outside your race, which used to be illegal. Before that, there were marriage Certificates. I don't know whether officials in other states balked at accepting the validity of a marriage that was licensed in one state, or whether the USSC has ruled on it. If marriage is a natural right, why beg a government for permission to do it? And if the State can license your marriage, can the State take that license away?
