  • Kansas still recognizes common law marriages. The requirements are thus: Both parties must be over 18 years of age. Both parties must have the capacity to make an agreement of marriage. The couple must publicly live as husband and wife. Living together is a part of that, but there are other things that also indicate marriage: sharing the same last name, holding joint accounts, filing joint tax returns, designating one another as beneficiaries on insurance policies, and the like. There is no time requirement for a common law marriage in Kansas, but for legal purposes, it may be difficult to prove your status under common law, especially when negotiating death benefits or separation. edit: I am not a lawyer.
