  • In my state, anything under 50 ccs does not require a motorcycle license to operate. By definition, that would make it a scooter. Some models of Vespa scooters, however, will put out more than 50 ccs of power.

  • I always thought it was wheel size - large wheels, motor cycle; small wheels, motor scooter and under 50 cc regardless of engine size, moped.
