I am a US citizen, having a child with an illegal immigrant. Does the child now make the father legal, or will he be deported from the US?

Your child is a legal US Citizen since that is also your status but having a child--either giving birth to a child by or fathering a child by a US Citizen does not automatically make that person a legal immigrant. The father of your child is not a legal immigrant. The father of your child needs to immediatly apply for "permanent immigrant" status or apply for US Citizenship

- The illegal immigrant is not eligble to become a US citizen because the child was born here. Now, last I heard, there is a mother camped in church claiming sanctuary because after giving birth immigration wants to send her back. Child can stay- not mother

- FYI: The child is a US citizen not only because the mother is a citizen, but because it was born in America.

Only your child is legal.

The father will have to go through the legalization process, just like every one else.

My husband is a illegal immigrant and weve been married for 3 years with 4 children but he remains a illgal immigrant reguardless of the children or martial staus. Unless he applies for documents.
