I am a US citizen, having a child with an illegal immigrant. Does the child now make the father legal, or will he be deported from the US?

    Your child is a legal US Citizen since that is also your status but having a child--either giving birth to a child by or fathering a child by a US Citizen does not automatically make that person a legal immigrant. The father of your child is not a legal immigrant. The father of your child needs to immediatly apply for "permanent immigrant" status or apply for US Citizenship

    Only your child is legal.

    The father will have to go through the legalization process, just like every one else.

    My husband is a illegal immigrant and weve been married for 3 years with 4 children but he remains a illgal immigrant reguardless of the children or martial staus. Unless he applies for documents.
