You're reading Heated divorce. 50/50 state. man puts his property in their house bedroom, boards the door and hires an armed guard. wife comes to collect her property and crowbars man's boarded door for entry. guard hits woman with gun. is this a civil or criminal case?

Wife had the papers, but restricted her to just her bedroom, not the boarded bedroom of her husband. wife did not call police, until the assault took place. in my city, the sheriff dept. only handles civil process. should the sheriff have taken care of this situation. it was civil. where do you draw the line between civil and criminal? keep in mind, this is a 50/50 state. the property is equal until the divorce is final.

I would think then yes the sherriff should have gotten envolved because the Attacker was not her husband and as far as I am concerned was a tresspasser and not welcome in her home (by her of course).

The husband did not have the right either to board the door she should have right to look and make sure None of her personal things were in the boarded room because after all the room is half hers also.

In a Metro area, the metro police handle the criminals and the sheriff handles civil process. the police handle domestic violence. my point was this, where did this situation become criminal and not civil. should the sheriff dept. have been the initial responder? its true, both have equal access to their property, until the divorce is final. the problem? both men and women have drained the atm, stolen their shared property and hired security guards to protect THEIR shared property. both have the right to live in the house, until final judgement. this is where the problem begins. domestic violence to the extent of murder. where is the line drawn? this is a fair question and a question the police are facing every day.
