  • I did have the money (I THOUGHT)...Like I said my fiance drained the account, therefore it bounced.
  • It was a joint account so there's not much you CAN do, other than plead your case to the DMV, produce evidence that you are not the one who cleared out the account, and keep your fingers crossed. I would also close the account immedietly and open one of your own, and shut down anything else joint that you have together.
  • Writing a bad check is typically not a felony but a misdemeanor. But even then it has to be proven that you knew the check would not clear when you wrote it. The DMV may choose to sue you for the money and they could feasably file a police report, but the chance you would be arrested is extremely remote. If you can in any way prove you did not know the check was bad, give a copy of that evidence to the DMV. It's in their best interest to work out a payment schedule with you. If they won't and you have someone able and willing, borrow the money (lay out a simple written contract or IOU), pay the DMV and they'll leave you alone.
  • Was the account closed? If it was, then your writing the check could be considered a felony because it appears as if you were trying to pass a bad check. Also, it depends on the criminal laws in the state where you live. In some states this is considered to be a misdemeanor. As long as you can prove that you were unaware that he emptied the account without your knowledge, you should be ok.
  • In most states arguing that you thought you had the money is the same as arguing that you thought the gun was unloaded. Borrow the money and pay the DMV to avoid the charges. You have a legal duty to be sure you have money to cover the check. The only legal excuse in most states for bouncing a check is if the person who drained your account did so through fraud. And if it was a joint account, then that excuse won't work.
