Example 2: A U.S. veteran shoots a wanted fugitive. Why? The wanted fugitive was trespassing, was carrying a firearm, and refused to surrender and/or throw down his weapon when ordered to do so. Not guilty.

  • If he shoots due to the perception of imminent danger or death, then not guilty. If he shoots just because of the trespass, guilty. Unless the fugitive has a wanted dead or alive warrant on him.
