  • Europeans can't access site, I had to search what a maga hat was :) No, I don't believe it is a hate crime, it's assault. We are allowed to disagree with political parties positions but as soon as violence is involved it becomes assault.

"A hate crime (also known as a bias-motivated crime or bias crime) is a prejudice-motivated crime which occurs when a perpetrator targets a victim because of their membership (or perceived membership) in a certain social group or race." They attacked this man because of his political beliefs. This IS a hate crime. So is running people out of a restaurant because of their political beliefs, imo.

In our country hate crime is classed as hostility or prejudice against someone for their disability, race, religion, transgender identity, and sexual orientation. As I understand it political beliefs can change they are not at the core of a persons identity it's just a preference. What happens if a man gets attacked because he supports the New York Yankies, or Manchester United Football team, or Chicago Bears, would this be considered hate crime? I think not because again it is a preference, a choice not an identity.

You can think not, but according to the definition it is.
  • Sounds like there are no innocent victims involved in the story. People should be legally allowed to wear whatever hat they want, have any political affiliation they want, etc., but trying to start a fight with a stranger over political differences means you will probably get into a fight.

Like the therapist told my ex - there is no button on you anyone can push that will MAKE YOU HIT SOMEONE. It is your choice. And anyone who does it is wrong. (unless its for training or agreed upon in advance or something like that, of course) I do find it interesting that they used the phone to get the license plate but no one recorded the actual incident? I agree with you on the rest of it though. Still I think crimes committed because of hatred over political affiliations should still be treated like hate crimes, because they are.
