What is the short term capital gains tax rate?

We live in Texas (no income tax); we have land for sale in CA. When it sells, do we have to pay Capital Gains Tax to CA even though we have no income in CA? How much is CA Capital Gains Tax rate? How much is the Fed Captial Gains Tax rate?

We would like to sell a 2nd home that was gifted to us. We are in the 10 or 15% bracket. If we wait until 2008 would we not pay $0 in capital gains under the TIPRA act of 2006?

If i have 0$ income and 100,000$ long term capital gains in 2008, will i pay 0$ federal income tax? remember that in 2008,9, and 10 that capital gains tax is 0% for the 2 lowest tax brackets. fwiw i file head of household. how is the tax calculated?
