If he can proove that he is totally destitute or unable to sustain himself financially, he may be able to delay payments until he can or work out some amounts that he is able to pay. However, I do not think that he will be able to avoid complete payment.

If your ex-husband has a lick of sense, he would not appear in court for this; he could most likely end up in jail for being a 'dead beat dad'. It would be in your best interest to go into court yourself to file a lack of payment notice.

For all the feminists out there... This is what equality looks like. Child support is a different issue. No person should be a financial slave to another.
