This is hard,because it making a rule would take away that person's free will.I think it depends what their incapability is.If it is something trivial-e.g a person cannot play badminton etc becuase they have no co-ordination,I would say forget a rule.On the other hand suppose it is important like being taken on for a job caring for children.The employer takes that applicant on because they believe they can do the job.The employee then proves himself to be totally incompetent with the children,even harms them.They are likely to get the sack-that is a rule they cannot work there and that is correct.

This question is an oxymoron if someone is incapable of doing something why would you need a rule banning them from doing something they obviously can't do.
