  • I would first get my student visa renewed. Your marriage may not be considered legal if you're here illegally. Do you have to apply to marry in your country? I think their rules would have some application also. Just my opinion!
  • As far as I'm concerned, it is not necessary for you to have a visa to have a legal marriage with your boyfriend. After all, immigrants who come ilegally get to marry and stay as well. If your boyfriend is up for it, marrying him would give you two benefits: 1. You would get a legal permit to work after two months of marriage. 2. You would get your green card any time from 6 months to 1 year after your marriage. The fact that your visa is expired only means that whenever you leave the US, you have to apply to the embassy to renew your visa. However, the I-20 is what really counts. If the I-20 is valid, then you still are legal here in the US (for it to be legal, you have to be going to school now).
  • Take the following steps: 1. GO HOME. There's no way you can legally marry your boyfriend under a student visa. 2. Obtain a K-1 fiancee visa. (Note: This is a NON-immigrant visa.) 3. Have your boyfriend file a form I-129F (Fiancee petition) with the Department of Homeland Security.
