What type of criminal/civil suit charges could I file against the person involved in an affair with my husband?

    What's wrong with you? Why are you wanting to blame the woman? And for what? Do you know her or what happened between your husband and her? Do you really want to have a woman come into a courtroom and tell everyone that she loves him and he loves her? Or that it was just for sex or fun? What is that going to do? Grow up fast or you will lose yourself to hatred and bitterness.

    This is between you and your husband.

    Get professional help to deal with your hurt and anger over the betrayal. And then when you do get help, take a long hard look at yourself and your marriage and then move on. Blaming is a waste of time.

    in some states you can civilly sue the affair partner if they knew your spouse was married. It is called "alienation of affection" You have to have proof positive Aside from that (which i'm sure is added legal expense) you could just say "ok bitch back at ya" and tell anyone around who will listen what a homewrecking ho-bag she is. It is not slander if you are relating the facts...she did sleep with my spouse, she knew we were married, knew we have kids and she did it anyway....makes her sound trashy and cheap however it is all true so what recourse would she have. You can state anything you like about anyone you like so long as it is truthful. If she is ashamed of herself (or himself if the vice versa applies) then that's really something they should have thought of before they themselves trashed their own reputation and character.

    You are asking the wrong question, concerning the other woman. you should be asking questions, concerning a divorce from your hushand.

    To answer your question. there are no laws that cover this situation. only a divorce will apply. get an attorney. get it done.

    Whether it's progress or not is another question, but there is little you can do along these lines anymore. "Alienation of Affection" is generally considered a quaint relic of a bygone era, and there are only a handful of states left where you can even begin to file such a suit. It's doubtful that she has broken any criminal law, unless she has taken anything without your husband's knowledge. The only thing that comes to mind is that if your husband has given her any gifts of serious value, then you may have some community property rights involved whereby you can recover something.

    That's the free opinion of a non-attorney stranger. Take it for what it's worth, and consider talking to competent counsel for sound advice specific to your situation.
