No, but you may see it as a distinction without a difference. You are not responsible for his debt. However, he is and the creditor can go after his assets to repay the debt. When your married, many assets are held jointly. So the creditor could not go after non-marital assets, but they could go after marital assets.

yes so run and get a divorce everyone! don't get stuck like me and have to pay over ten grand in medical because your husband is too cheap to pay 80 bucks a month for medical insurance thru the job and he is a crook and ends up in prison and you are left in the world working 2 jobs and getting dunned for all his stupidity. I don't think you are legally responsbile for your husband's debts but if you like you can help him pay the debts if you can afford too, otherwise you are not obliged,and if you help pay but do not sign anything. well i used to be a bill collector for a credit card company and we were told to always ask for a spouse..and try to get payment arrangements set up to pay for the debt.. bc you are married his credit is your credit as sad as it is to say.. but i don't believe they can garish your pay checks unless you are the only one making money.. if you live in certain states they can not speak to you regarding his debit even tho it effects credit scores.......http://www.creditcards.com/credit-card-news/spouse-debt-collection-asset-protection-1282.php that's just a little article about credit card issues.
