  • That is a terrific question. I hope someone can answer it. I am looking for help in a parking problem we are having and board members that are out for themselves and not the association.
  • No one. Complaints are handled by the States Attorneys General but no one regulates them to make sure they don't over exercise their power over property owners in the U.S.A. Each citizen must take on the HOA each and every time, for ever and ever, each time an HOA overreaches. It is a quasi-Gov't entity without checks and balances. If an HOA is in good standing it is not by design but is only through the good graces of those who serve on the board at that moment in time. Certain States have chosen to protect its citizens from entities such as this, e.g., Maryland Condominium Act (Title 11) or the Maryland Homeowners Associations Act (Title 11B). It varies by State. Please note, Banks and lenders may not be too comfortable with out-of-control HOAs that jeopardize their investments. Getting them involved is an option in some cases.
  • What can be done about selective enforcement? i.e. One owner can not park in the vistors parking spaces but another can, or at least they are not targeted with complaints.
