  • If the decree was heard before a Judge and the Judge granted the divorce, then you are divorced even if the final papers are not filed. This from personal experience. What matters is the date of the judgement not the date of filing. Our divorce decree was not filed for over 2 years due to being dropped by her attorney. Discussing this issue with 2 different court facilitators in different counties, as well as legal council, all agreed that filing did not matter it was the date of judgment that mattered. There was never an issue of not being divorced during those two years.
