  • The parties meet with a third party (with or without their attorneys) whose job is to facilitate a settlement. Generally he gets the parties to focus on the important items and negotiate a settlement that is free (or should be free)from the adversaral system. The mediator frequently meets with each party after an initial joint meeting separately and focuses on just what is most important to them. Frequently the mediator finds tht the parties ultimate position is very close and the attorney's positioning has gotten in the way. It generally takes only a day to settle everything if the parties are open to discussion. Everything said and done there is confidential and can;t be used in the divorce action ifit falls through.
