I need to apply for a passport for my daughter but her dad will not sign the application unless i remove him for child support can i apply for it on my own and will i get throw?

If you have joint custody then I do believe you need his consent for her to leave the country, just as you would not want him to leave the country with her without your consent. If he has no custody and is using it as a leverage tool to simply get out of child support, then that should be put in writing and submitted to the Friend of the Court to show his abuse and attempts at eliminating his child support. I do believe he might have to provide reasons for denying her permissions to leave the country. Should he be afraid to let her leave the country? Are you leaving the country for good? Are you going to a dangerous destination? Have you threatened to take his daughter away for good before? Too many questions come into play here.

My answer won't be very helpful but I symathise with you. What an manipulating, irresponsible jerk your daughter's father is! I'd ask for some free legal advice about what you can possibly do.

Unless you have court ordered sole legal ans physical custody, you need his signature. Since he is such a jerk and obvioulsy has no interest in your child, you should try to get sole custody. Or you could relenquish child support if he will relinquish parentl rights and let your husband adopt her. Anyway, looks like you need a lawyer...a nice MEAN one who will really stick up for your daughter. if you want to keep geting chld support you will end up putting up with the jerk. Might not be worth it.

I am a father who would love to sign the passport but I will not because she doesn't let me see my child, I don't know where she is going, she's asked me to sign over the rights of my daughter several times, and also the guy she is going to marry is from out of the country and I don't know what they are planning to do and I have yet to meet him after 3 yrs. This is why I will not sign and I pay child support and do everything but can't afford a lawyer. What should I do?

I forgot to write that I wont sign the passport unless she gives me more visitation also. She always cancels my visitations and says she busy or sumthing comes up. It's ridiculous.
