If one parent lives somewhere that offers joint custody and the other lives somewhere that doesn't offer joint custody, can the parents file for joint custody in the place that allows it?

    If one parent lives in such a jurisdiction then, yes, it is possible to apply to the courts for an order awarding him or her joint custody. It may be difficult to have an existing order or agreement changed, but if a valid reason can be provided to support such a change, the courts may grant it. The new order would need to be presented to the legal authorities in the other jurisdiction and they would determine whether such a change should be enforced.

    If it is refused, the person with the new order would need to apply for the change in the jurisdiction where the child lives, based on the strength of the order granted in his or her home jurisdiction. However, courts tend to take a dim view of people using differences between jurisdictions to try and get their own way by force.

    so sad....why can't parents jointly come to terms , without courts, for the best interest of their child.....not themselves....or who gets ch. support, etc.....
