Is it a crime to sit in your parked car and drink a beer?

I'm not sure if it is in New York but I would assume so. The idea would be that your intent would then be to drive after drinking. I suppose though if you only had say, one beer in the car with you and you passed a breathalyser you might have an argument. Doesn't sound like much fun to me though to sit in the car and drink....

The only problem here is before and after the fact. If you become intoxicated, while drinking a beer in your stationary auto, the police can presume you are an intoxicated driver, since the vehicle did not drive itself, to your location. Why take the risk? Go home to drink your beer. if you become intoxicated, just go to bed. Its safer.

In Wisconsin it would be an open container ticket and a test to check blood/alcohol can lead to DWI

It is illegal to have an open container of any kind of alcohoic beverage in a vehicle IN NY.

i suppose if you had the keys not in the ignition in your parked car, and you weren't sitting in the driver's seat, there's not much they could say to you is there?

Having just got over an 12 month drink/driving ban, I dont think so....
