  • I doubt it, not if talking on a cell phone while driving is illegal wherever you happened to be talking. You still committed the offense, no matter where the cop wrote the ticket. The law just doesn't work that way.
  • It all depends on how old you are. If you're an adult, there's a chance the judge will have your back.
  • No you don't have a case. In Texas we don't have a specfic law about cell phones, but it under failure to control your vehicle. Hope this will stop you from talking on your cell while driving. It's not safe.
  • Does it matter? You were still doing something illegal which endangered other road users. Pay your ticket, and do a bit of research about the reason for the law.

  • If this occured in the officers jurisdiction, the citation is valid. The officer apparently asked you to move your vehicle for safety reasons. Any corrections can be made in open court, by the officer.

And quit talking on your damn phone while driving. I almost got killed not more than a week ago because some woman on the phone decided to turn into my lane - I ride a motorcycle. If you absolutely must talk while driving, get an ear piece (hardwired or bluetooth) or car-speaker adapters, or put it on speaker phone, or any other number of possible option. Talking is a distraction enough, but to have one hand off the wheel pressing half your hearing shut, with your hand blocking half your vision... is dangerous. And it should be illegal. And they should enforce it to the full extent of the law. It sucks when you get ticketed, so dont do it. Its a good thing to those of us you may kill... Although you may feel guilt, it is by no means an "accident" I tried fighting a measly $101 ticket. I lost the case and ended up paying $200 total, after court fees. And I -actually- had a case.

  • Nope. In fact I hope you get more tickets for talking on a cell while driving. People who do that are easy to spot. They usually have bad lane control, and often drive horribly because they are distracted. I almost get hit daily by some moron who won't get off their phone. Get off your phone and drive. I don't want to get into an accident because some idiot wanted to talk to their friend.In fact I will go so far to say that if I do get into an accident because someone hit me while they were on a cell phone, I would very likely beat the living hell out of them. Inconsiderate asses like those, and YOU, are ruining the roadways of America.
