  • It depends on who you work for and if the holidays are paid. My holidays are paid, so I know for sure they count towards my hours. Generally, they should be, but you would have to double check with your employer.
  • As far as FLSA (Fair Labor Standards Act) rules go, no they don't. In order to get paid for overtime, you need to WORK more than 40 hours, not just get paid for 40 hours. Some employers may pay you overtime if your work and holiday/vacation hours are more than 40, but they are not required to.
  • No. It's hour your employer "suffers or permits" you to work (in California, similar language in US federal law).
  • I'm sorry "Miss". You are not correct. Paid holidays have no bearing on the requirement to count holidays toward overtime. FLSA states "hours worked". If your company is counting your holidays toward overtime, "Don't Look a Gift Horse in the Mouth"!
