I married a woman from Kenya and never filed any papers. Her visitor visa expired a year later, but she's still in the country. Is there any penalty or danger for her to file now?

    You should immediately file an I-130 and an I-485 for your wife. As the "immediate relative" of a U.S. citizen, she is elligible to adjust status.
