I was rear-ended and the other guys insurance company is not returning my calls (or picking up) or attempting to pay for the damages brought upon by their policy holder. How can I get them to respond and fix my car?

You should contact your own insurance company any time that you have an accident, whether or not you are at fault. They will find out about it anyways, if the police or an insurance company is involved. Your insurance company can chase them and, if the other driver does not have adequate insurance, your own company may reimburse you themselves.

Call the insurance commissioner. That will take care of it. They will get a fine if they don't handle it appropriatley after the complaint, so they usually pay up quickly.

Are you positive the other driver has auto insurance and was it active at the time of your accident? not returning a phone call, is a red flag. contact your insurance agent and advise him of the situation. your insurance company has attorneys that do nothing, but handle cases like this. some, eventually are settled in civil court.
