    Yes. In Texas the mentally ill, the mentally retarded, and the innocent are executed. Texans believe, if you don't execute the mentally ill, the retarded, and the innocent, how will they ever learn?

    The mentally ill of Texas who somehow escape execution become their politicians. This is how Dubya became governor, and later, Rick Perry.

    That depends on the severity of their mental illness.

    it was unconstitutional to execute the insane (Ford v. Wainright, 1986), but it was constitutional to execute the mentally retarded (Penry v. Lynaugh, 1989) and it is unconstitutional to execute an offender who was 15 or younger when the crime was committed (Thompson v. Oklahoma, 1988)

    If you seriously want to educate yourself on the subject, read the information on the Death Penalty Information Center's website. http://www.deathpenaltyinfo.org/

    There is a difference in mental illness and mental retardation. The Supremes again stated that execution of mentally retarded persons is unconstitutional in 2002 in Atkins. Mental illness generally comes into play in an insanity defense, but the Ford case banned the execution of the insane.

    Another related issue is whether a defendant is sane enough to even be tried. Defendants have to be able to participate in their own defense so if they are completely insane they may not even be tried, but rather institutionalized.
